TARZO MEDIA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT REPRESENT THAT ALL PRODUCTS, PRICES, OR RANKINGS ON THE WEBSITE ARE EXHAUSTIVE OR CONSTITUTE ENDORSEMENTS. PRODUCT RANKINGS AND SELECTIONS ARE GENERATED BY OUR ALGORITHMS AND REFLECT SUBJECTIVE CRITERIA SELECTED BY TARZO MEDIA — THEY ARE NOT RECOMMENDATIONS.

IN ALL CASES, TARZO MEDIA'S MAXIMUM AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100).

10. Indemnification
You agree to indemnify, defend, and hold harmless Tarzo Media and its officers, affiliates, employees, agents, and licensors from and against any claims, losses, liabilities, damages, and costs (including reasonable legal fees) arising from: (a) your use of the Services; (b) any violation of a third party's rights, including intellectual property or privacy rights; or (c) any breach of these Terms.

12. Takedown Requests

We will make reasonable efforts to investigate and address valid complaints promptly.
13. Termination
Tarzo Media may suspend or terminate your access to the Services at any time, with or without notice, for any reason — including violation of these Terms. Upon termination, all licences granted to you under these Terms will immediately cease. Tarzo Media may delete any associated content or data at its discretion. Sections 1, 2.2, 3–14 shall survive termination.
14. Dispute Resolution
14.1 Arbitration Agreement
All disputes, claims, or controversies arising out of or relating to these Terms or the Services ("Disputes"), other than claims relating to intellectual property infringement ("Excluded Disputes"), shall be resolved through binding individual arbitration rather than in court. You and Tarzo Media each waive the right to a court trial or jury trial in respect of Disputes.
14.2 Arbitration Rules
Arbitration shall be conducted through the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or an equivalent arbitral body if the AAA is unavailable. Claims under USD $10,000 may be resolved by non-appearance-based arbitration (telephone, online, or written submissions). Any arbitration award may be entered in any court of competent jurisdiction.
14.3 No Class Actions
ALL DISPUTES MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR CONSOLIDATED PROCEEDING. IF THIS WAIVER IS FOUND INVALID, THE ARBITRATION AGREEMENT SHALL NOT APPLY TO THAT CLAIM.
14.4 Opt-Out
You may opt out of this arbitration agreement by notifying Tarzo Media in writing within 30 days of first becoming subject to these Terms. Your opt-out notice must include your name, contact details, and a clear statement that you wish to opt out. Send your notice to: service@tarzomedia.com.
14.5 Excluded Disputes — Governing Law and Jurisdiction
Excluded Disputes shall be governed by the laws of England and Wales. The parties submit to the non-exclusive jurisdiction of the courts of England and Wales for any Excluded Dispute.
15. General Provisions
Severability: if any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.
Entire Agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and Tarzo Media regarding the Services.
Assignment: Tarzo Media may assign these Terms at any time. You may not assign your rights or obligations without our prior written consent.
No Waiver: failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in future.
Limitation Period: any claim arising out of or relating to the Services must be brought within one (1) year of the cause of action arising, or it will be permanently barred.
Third-Party Beneficiaries: no provision of these Terms is intended to confer rights on any third party except where expressly stated.
